The regulations specify the conditions and rules for sale on the website www.MonikaSpiewak.com. The website belongs to the company Monika Śpiewak, Radzionkowsk 36, 64-622 Świerklaniec, Poland. - NIP: PL626-155 51-48; REGON 278181457
1. Only adults can place orders in the Gallery.
2. The sale takes place via the Internet in the form of a distance contract between the person placing the order, hereinafter referred to as the Buyer, and the Gallery.
3. A necessary condition for the execution of orders is that the Buyer correctly completes the appropriate order purchase form available on the website www.MonikaSpiewak.com.
4. Placing an order by the Buyer is tantamount to accepting the provisions of these regulations.
5. The Gallery reserves the right to withdraw from the order if the form completed by the Buyer contains incomplete, incorrect or false data.
6. Acceptance of the order for processing is confirmed by e-mail. The gallery constantly informs the buyer about changes in the order status via e-mail.
7. The Gallery undertakes to send the goods purchased by the Buyer within a maximum of 5 business days from the moment the order is accepted for processing.
8. The Seller delivers the shipment to the Buyer via the GLS courier company.
9. The prices of the offered paintings and accessories available on the website www.MonikaSpiewak.com are expressed in EURO and include VAT.
10. The shipping cost and possible return cost is €0.
11. The buyer is obliged to pay for the ordered goods in accordance with the selected form of payment.
12. The Gallery undertakes to send the goods purchased by the Buyer within 10 business days from the moment the order is accepted for execution, unless the parties have agreed otherwise.
13. The buyer has the right to refuse to collect the ordered goods and demand a refund only if the ordered item is found to be damaged or destroyed.
14. There may be slight color differences between the presented photos of the goods and the original. This may be caused by different settings or properties of the Customer's computer equipment.
15. The Buyer may withdraw from the contract without giving reasons within 14 days from the date of delivery of the ordered painting. This is only possible if the goods have not been used and are undamaged.
The return of the painting in an unchanged condition together with a written declaration of withdrawal from the contract is at the Seller's expense. The cash refund for the returned goods will be made within 5 business days from the date of receipt of the returned painting, to the bank account indicated by the customer. Please send returns to our address.
16. After receiving the shipment, the Customer should check the condition of the painting. If you find any discrepancies or damages, please send an e-mail to info@MonikaSpiewak.com.
17. Complaints regarding the purchased goods should be submitted by the Buyer to info@MonikaSpiewak.com .
18. Complaint consideration deadline - 3 business days. The customer will be informed about the decision regarding the submitted complaint by e-mail to the e-mail address provided when placing the order.
19. The Gallery is not liable for the consequences of random events beyond its control and which prevented or hindered the performance of the contract (power outage, IT system failure, flood, strike, border closure, etc.).
20. The administrator of personal data is Monika Spiewak with its registered office at ul. Radzionkowska 36; 42-622 Świerklaniec; NIP6261555148; REGON 2728181457.
21. The parties will try to resolve all disputes amicably, and if such an agreement is impossible, the dispute will be resolved by the court having jurisdiction over the Seller's registered office.
